An Amendment by itself can not cause an indictment, because jurisdiction with the federal structure has not been conferred. That’s what a statute would do. I’m quite familiar with the ins and outs of the Constitution although I don’t claim to be an expert, but I can tell you that when the 18th Amendment was repealed by the 21st Amendment, all statutes that were created under the 18th automatically became null and void as unconstitutional. In order to back the 21st Amendment, new statutes that were probably similar but not the same needed to be done.
Your reflection of concern over ex post facto law is correct.
Officer, please explain exactly what laws Oliver has broken.

Oliver Canby said…ND: Nope. I wouldn’t join ND over my dead body.
Sam Eagle: I’m not sure exactly which states have ratified it. I think a couple Southern states and maybe California too. I think Congress would have no problem passing a statute defining neurodiversity and the trial procedure. It may have to be the case that anyone who commits ND before the statute’s passage may avoid execution due to a loophole, but in the long run this amendment is still a good thing. I think you would be right about the statute’s being unconstitutional if this amendment was ever repealed, but I don’t see that happening. If the statutes that banned alcohol were unconstitutional after the 21st Amendment (which they were), would they have needed to be replaced at all? I guess it’s possible that there could be a new alcohol statute that didn’t ban it outright like the 18th Amendment did. The “Officer” is now banned from this blog as he attempted to provide a link to a blog that is critical of me. Such links will not be published.

Sam Eagle said…I apologize for accusing you of not allowing my previous detailed comment. Are you able to find out which states have ratified it? There may be a pattern to them and place pressure on those within that pattern. If so you should exploit that pattern.
I see another issue. This “neurodiversity” that has been commenting here appears to think you have the definition wrong. Now if the statute that is passed after your Amendment is ratified defines it your way, this group may well challenge the statute on the grounds of incorrect definition. If they were successful that would not only remove the statute but it may also threaten the Amendment. What would be your preferred response to this?

neurodiversity said…You are not a good, benevolent person. A good, benevolent person would not seek the death penalty for anyone outside of war and there is no war here. I repeat, you are irrational and desperately need help. You express your opinion as though it is fact and it is not.

October 24, 2015 at 5:47 PM
Oliver Canby said…Anon: There is no evidence at all that Rev. Hamer hated black people, or that he was a self-hating black. That would be completely incongruent with his Christian faith. Please show evidence that the Christian Anti-Defamation Commission is racist. I don’t doubt that the SPLC calls them a “hate group,” but that would be due to their anti-gay views.
ND: I have never expressed my opinion as if it’s fact, and I’m definitely not engaging in war. I’m simply a citizen participating in democracy. Our society has long allowed the death penalty, and the Supreme Court has upheld its constitutionality numerous times.
Sam Eagle: I’ll look up which states have. So far it seems to be states that lean Republican. Hopefully, that ND idiot will be ignored as Congress will correctly define it, but perhaps they should revisit the amendment and make the wording more clear.

In war, people are executed for the greater good! Neurodiversity is a political group and Oliver is not a member as he has already told you! Open your eyes, fuck wit! Oliver wants a cure and so do many others, including Ruby! You have no right to deny that to them! Oliver wants democracy and you don’t!
That’s a FACT for you, dickhead!

Oliver Canby said…You go, Informer! Way to tell him off.
ND: You are right that I am human, unlike any of you. I will not be silenced.
Anon: That still doesn’t necessarily mean that they’re racist. The SPLC may not categorize specific hate groups. Also the SPLC even categorizes black “civil rights” groups the Nation of Islam and the New Black Panther Party as hate groups, due to their anti-white and anti-Semitic views.

The sixty eighth response;
neurodiversity said…We are all human, Oliver. We are all neurodiverse. It’s a part of being human. It is not a political group as The Informer mistakenly claimed. Informer, the innocent are executed in a war and that is never for the greater good. A cure for any natural neurodiverse condition such as Autism disallows the natural progression of humanity. Oliver does not want democracy. He wants a dictatorship that does not allow for the progression. Congress will never allow this and it is why there is no ratification process going ahead at present.
October 26, 2015 at 3:32 PM
Oliver Canby said…Wrong again, dude. You have a gross misinterpretation of the word “neurodiversity,” which is defined specifically as, “opposing a cure for autism.” It does not mean “brain difference,” as its roots might suggest. It is indeed a political movement, led by multiple organizations but most prominently by the Autistic Self-Advocacy Network or ASAN. People are killed (not executed) in war, and it’s for one of two reasons: either you were a bad person who deserved to die or you were a hero who died defending our country. Autism is definitely not a natural condition, and it is far from progressive. In fact, it is regressive, which is the opposite of progressive. There is no such thing as “natural progression.” That is a ridiculous, Darwinistic, evolutionary belief that is directly contrary to the Bible and the book of Genesis. It is the prevailing belief in Darwinism that has allowed the slaughter of millions of unborn babies under the guise of a “woman’s right to choose.” I absolutely support democracy; I don’t like dictatorships. That is why I live in the USA, where an ordinary citizen like me can propose a constitutional amendment. Your ridiculous words are straight out of the ND playbook, and they are truly laughable.

Without the Autistic Spectrum we would never have had the industrial revolution, scientific advances, computer technology and so forth. Many of the genius’ of the past were on the Autistic Spectrum. You have no respect for life and culture and you will never be respected by the community at large. You are a failure.

I agree with Leader. A fair warning that shouldn’t be ignored.

Oliver Canby said…Anon: It says there is clearly a genetic PART to autism. Autism is far from 100% genetic.
Alan: Autism is indeed a disease, and scientists are working on a cure. It is extremely demeaning to autistic people to imply that they bring their own problems upon themselves. Simply comparing autism to being black greatly trivializes it. I cure is about improvement, and I’m all for that.
