Lyle said…McVeigh was a terrorist. It’s historical fact. The IRA were terrorists. That’s historical fact too. A Muslim is not a terrorist just because they are Muslim. ISIS are terrorists. Many Muslims reject them.
A terrorist is a person who uses violence and death to achieve a political agenda. McVeigh, the IRA and ISIS all fulfill that criteria. Technically so do you with your Amendment that seeks death for a political agenda. You can not deny it. To do so would be to the detriment of your already wrecked reputation.

Sam Eagle said…In order to do that, a fresh piece of law needs to be put through Congress. The Constitution does not operate law. It provides background authority to make law. Without a law to authorize what you want, the Amendment is useless.
By the way, which version of the Amendment is being ratified? Your original, or Ruby’s amended version? If it’s the latter has it been voted on in Congress yet?

Oliver Canby said…The version that I submitted is the one awaiting ratification. Once it is ratified, Congress will quickly pass legislation which will detail the exact trial procedures and what not. It should be noticed that in our system of “common law,” the law is often left intentionally vague and there tends to be an over reliance on judicial precedent.

Sam Eagle said…That’s why I asked the question, because judicial precedent is an enemy of a new law if it is not presented correctly. The Supreme Court can strike a poorly worded law out on precedent alone even with the change to the Constitution, and in exceptional circumstances could lead to the Amendment being struck out by default.
You need to go back and take Ruby’s version to Congress and start again. Your original will not work as you intend it to.
Lyle, Oliver is right. It’s not treason to question the President. If he is right, the President could in fact be guilty of it but there is no solid proof that he is a Muslim. It’s only speculation.

For example, the Boston bomber Dzhokhar Tsarenev has been sentenced to death by the federal government despite the fact that Massachusetts does not allow the death penalty.

How would you expect them to define it specifically? It is a complex process and can not be done with a snap of the fingers. Rushing it through maximises the chances of it being struck down by the Supreme Court.
I have another question. Should your version be ratified by the needed number of states (how is that process going by the way?) and those who would fall foul of it contest it before the statute with it is even considered, what would you do then?

Sam Eagle: The statute would likely define neurodiversity as militantly opposing a cure for autism and trying to prevent a cure for autism from being established, similar to Ruby’s definition. I would think it would take time (being studied in committee and all), and I agree that it shouldn’t be rushed through. Last I checked, only about three or four states have ratified the amendment, so it still has a ways to go. I would think that the amendment itself might be enough to cause an indictment, even without the subsequent statute. For example, the 18th Amendment was enough to ban alcohol, and the subsequent statute basically just elaborated on how exactly alcohol was banned. I’m not a Constitutional expert, though, so there might be a question of it being considered an ex post facto law and declared unconstitutional. I would think it’s pretty safeguarded, but perhaps Ruby’s wording should be used in the amendment itself.
